State of Ohio issues statement of charges against psychiatrist David W. Massie

On September 14, 2011, the State Medical Board of Ohio issued a statement of charges against psychiatrist David Walter Massie.

According to the Board’s document, Massie entered into a Consent Agreement with the Board in November 2007 in which Massie admitted a dependence on the controlled substance Oxycontin; that he had entered and then left chemical dependency treatment and that he had impaired ability to practice medicine with acceptable standards of care as a result.

Massie was on Oxycontin following a neck injury and cervical fusion. Massie further admitted that he’d entered into arrangements with patients to give him a portion of their Oxycontin prescriptions.

His license was suspended indefinitely at that time.

In April 2010, Massie and the Board entered into a Superceding Consent Agreement which included numerous conditions, which Massie was found to not be in compliance with. For instance, the Agreement required that Massie abstain from the use or possession of drugs, except those prescribed or administered by a medical professional and that Massie was required, among other things, to notify the Board within seven days, providing the identity of the prescriber; the name of the drug; the medical purpose for the drug; the date received, etc. Massie failed in numerous instances to comply with these requirements. He was additionally required to abstain from the use of alcohol but in August 2010, his vehicle was pulled over by police who found him, as a passenger in his own car, in a state of alcoholic intoxication. Urine screens tested positive for alcohol on six days, both before and after the traffic stop.

Further, there were other requirements which Massie failed to comply with.

The Board will seek to suspend, revoke or otherwise discipline Massie’s license.
