Psychiatrist Jane C. Gilbert Loses License for Sex with Patient
January 11, 2019
An Oakville psychiatrist who had a prolonged sexual relationship with an erectile-dysfunctional patient lost her licence to practise Wednesday.
Dr. Jane Catherine Gilbert pleaded no-contest at a College of Physicians and Surgeons discipline committee hearing for having sex with “Patient A” — whose identity is covered by a publication ban.
A doctor who has sex with a patient faces mandatory revocation.
“She exploited this patient to satisfy her needs, wants and desire by initiating a lengthy sexual relationship with Patient A,” said college prosecutor Carolyn Silver.
“She flagrantly violated her fundamental responsibility as a physician.
“She turned the physician-patient relationship upside down and betrayed the trust placed in her, and now he has said in his victim impact statement that he no longer trusts psychiatrists.”
Gilbert supplied Patient A with non-prescription erectile dysfunction drugs ‘from a third-world country,’ as well as narcotics and a penis ring ‘to maintain an erection,’ said Silver.
Gilbert was treating Patient A — who suffered from depression, lymphoma and prostate cancer — since Nov. 2009 at Oakville-Trafalgar Memorial Hospital, said Silver.
During a Sept. 2010 appointment, Dr. Gilbert started crying and revealed that her husband was leaving her. Patient A hugged her and the doctor accepted his invitation to dinner that night at his home with his wife, said Silver.
Gilbert then became friends with Patient A and his spouse. The psychiatrist started visiting Patient A’s home while his wife was at work and would drink together for hours, said Silver.
In the fall of 2010, Gilbert revealed “she was attracted to him and wanted to cultivate ‘that kind of friendship,’” said Silver.
He had undergone a prostatectomy and “it took a long time to get an erection,” said Silver.
“Wouldn’t you like to get back on track and take that back to (your wife)?” Gilbert asked him.
She offered to fellate him, but he declined. Gilbert masturbated him while he fondled her.
“Patient A hadn’t had sex with his wife in many years. His sexual encounter with Dr. Gilbert was very emotionally significant for him,” said Silver.
Patient A told Gilbert “he loved her and would leave his wife for her,” and she responded with love letters to him.
Their sexual relationship — which included kissing, oral sex and intercourse — continued un6til April 2014.
The psychiatrist, who began practising in 1990 but didn’t attend the hearing, lost her licence immediately and faces a future reprimand.
