Massachusetts Psychiatrist Gustavo Kinrys Indicted for $10 Million Medicaid Fraud

A psychiatrist with a practice in Natick has been indicted on charges that he billed Medicare and private insures for services he never provided, federal prosecutors said Thursday

Wellesley resident Gustavo Kinrys, 49, was arrested Thursday and charged with seven counts of wire fraud, six counts of making false statements about medical care, fabricating documents and obstructing a criminal health care investigation, authorities said.

Kinrys operated the Advanced TMS Associates clinic at Leonard Morse Hospital, where he provided a brain stimulation therapy used to treat depression. But between 2015 and 2018, Kinrys billed Medicare for about $10 million transcranial magnetic stimulation (TMS) therapy that never occurred, prosecutors said.

He also billed Medicare and private insurers for about 1,000 therapy sessions that never happened, prosecutors said.

"On hundreds of occasions, it is alleged that Kinrys billed Medicare and private insurers for having provided more than 24 hours' worth of psychotherapy services in a single day, including one day in 2017 when he claimed he had provided hour-long psychotherapy sessions to 79 different patients," the U.S. Attorney in Boston said in a news release.

The charges carry prison penalties, and fines starting at $250,000, according to prosecutors.
