Feds withdraw from plea deal with child psychologist accused of possession of child porn

January 11, 2018

Federal prosecutors withdrew from their plea deal with child psychologist Kenneth Breslin, who was accused of downloading thousands of child pornography images, after he allegedly continued to download images while out on bail.

Breslin, a child psychologist in Califoria who ran his own practice called A Child's Point of View, will most likely be facing new criminal charges in federal court.  Two years ago, police found thousands of child porn images on his computer.  Breslin was charged first in state and then federal court, posted bail and eventually agreed to a plea deal.  The plea deal was supposed to be finalized last year, but started to fall apart when it came to light that he continued to download and send images with file names associated with child porn and tried to disguise the activity.

“Based upon the government’s belief that Mr. Breslin has committed new federal crimes, repeatedly and flagrantly violated the conditions of his pretrial release, and failed to clearly demonstrate acceptance of responsibility for his offense, the government hereby withdraws the plea offer,” Assistant U.S. Attorney Christina McCall wrote in a notice filed in Northern District court Tuesday.
