Psychiatrist James M. Napier suspended indefinitely

On December 10, 2010, the Vermont Board of Medical Practice suspended indefinitely the license of psychiatrist James M. Napier for failure to file Vermont income withholding tax returns since April 17, 2009.

Vermont’s state tax law require that an agency shall revoke or suspend any license or other authority to conduct a trade or business…issued to any person if the agency finds that taxes…have not been paid and the taxpayer’s liability for such taxes is not under appeal.

Napier did not provide any evidence that such an appeal is pending and he has not, according to the Vermont Board’s document, pleaded hardship as a reason for not filing.

His license is suspended until such time that as the Department of Taxes certified to the Board that Napier is in good standing with regard to his state taxes.
